USER AGREEMENT

of the Astana Bilim Academy educational platform

This User Agreement (the "Agreement") sets out the terms of use of the Astana Bilim Academy educational platform (the "Platform") by users.

The Platform is owned and administered by Astana Bilim Academy LLP, BIN 250640007207 .

Use of the Platform means that the user has read this Agreement and accepted its terms in the manner provided for herein.

1. General Provisions

1.1. The Platform is an information system designed to organize and support the educational process, including distance learning, providing access to educational materials, completing assignments, undergoing assessment, obtaining information on training progress, and using other functionality.

1.3. Astana Bilim Academy LLP grants the user the right to use the Platform solely in accordance with this Agreement and the legislation of the Republic of Kazakhstan.

1.4. This Agreement governs solely the use of the Platform and does not replace:

– the Public Offer Agreement for the provision of paid educational services;

– the Consent to the Collection and Processing of Personal Data;

– the Astana Bilim Academy Privacy Policy.

1.5. The terms for the provision of paid educational services, including the cost of training, payment procedure, refunds, certificate issuance conditions and other training terms, are determined by the Public Offer Agreement for the provision of paid educational services.

2. Terms and Definitions

2.1. Platform (LMS) — the Astana Bilim Academy learning management system designed to automate and organize the training process.

2.2. User — an individual who has registered an account on the Platform or otherwise obtained access to the Platform through a method provided by Astana Bilim Academy LLP.

2.3. Account — a user's personal account created to identify the user and provide access to the Platform's functionality.

2.4. Personal Account — a protected section of the Platform accessible to the user after authorization.

2.5. Educational Materials — video lectures, presentations, documents, tests, assignments, methodological materials, images, audio materials and other materials posted on the Platform.

2.6. Course — an educational program or part thereof posted on the Platform.

2.7. Administrator — an authorized representative of Astana Bilim Academy LLP who carries out technical and/or organizational administration of the Platform.

3. Registration and Account Creation

3.1. Registration and creation of an account may be required to use certain functionality of the Platform.

3.2. Upon registration, the user must provide accurate, up-to-date and complete information.

3.3. The user is responsible for the accuracy of the registration data provided.

3.4. The user must promptly update registration data in the event of any change.

3.5. The account is personal and is not intended to be transferred to third parties.

3.6. The user may not provide third parties with the login, password, confirmation codes or other data allowing access to their account.

3.7. All actions performed after successful authorization in the user's account are deemed to have been performed by that user, unless proven otherwise.

3.8. Upon discovering unauthorized access to the account, the user must promptly notify Astana Bilim Academy LLP.

4. Authorization and Security

4.1. Access to the Platform is carried out using the authorization methods provided by Astana Bilim Academy LLP.

4.2. The user must take reasonable measures to ensure the security of their account, including: not disclosing the password to third parties; not saving authorization data on publicly accessible devices; using a strong password where such a feature is provided by the Platform; logging out after finishing work on a shared or third-party device.

4.3. Astana Bilim Academy LLP has the right to temporarily restrict access to an account where there are grounds to believe it is being used in breach of this Agreement or the legislation of the Republic of Kazakhstan.

4.4. In the event of a block or restriction of access, Astana Bilim Academy LLP may request information necessary to confirm the user's identity and the lawfulness of their use of the account.

5. Use of the Platform

5.1. The user may use the Platform: to complete the educational programs available to them; to view and study the materials provided; to complete assignments; to undergo testing and assessment; to view information on training results; to receive notifications related to training; to use other Platform functions made available by Astana Bilim Academy LLP.

5.2. The functionality of the Platform may vary depending on the course, the user's status and other organizational conditions.

5.3. A user's access to a specific course is determined by the terms of the Public Offer Agreement where the course is paid.

5.4. Astana Bilim Academy LLP has the right to change, supplement, update or improve the functionality of the Platform.

5.5. A change to the interface, layout, design or individual technical functions of the Platform does not constitute a change to the terms for the provision of educational services, provided such change does not affect the scope of educational services envisaged by the course.

6. Educational Materials and Intellectual Property

6.1. All educational, methodological, informational, audiovisual and other materials posted on the Platform belong to Astana Bilim Academy LLP and/or the relevant rightsholders and are protected under the legislation of the Republic of Kazakhstan.

6.2. Granting the user access to educational materials does not constitute a transfer of exclusive or other proprietary rights to such materials.

6.3. The user may use the educational materials solely for personal educational purposes and within the scope of the access granted.

6.4. Without the prior written permission of Astana Bilim Academy LLP and/or the relevant rightsholder, the user is prohibited from: copying educational materials in whole or in part; distributing them to third parties; making them publicly available; selling or transferring them to third parties; publishing materials on third-party websites; using materials to create derivative commercial products; otherwise using materials beyond the purposes of personal training.

6.5. Recording video lectures, webinars, audio materials and other events conducted using the Platform is permitted only with the prior permission of Astana Bilim Academy LLP and subject to the rights of other participants.

6.6. The provisions of this section apply regardless of whether the course is paid or provided to the user on other terms.

7. Prohibited Actions

When using the Platform, the user may not:

7.1. Use the Platform for purposes contrary to the legislation of the Republic of Kazakhstan.

7.2. Transfer their account or grant access to it to other persons.

7.3. Attempt to gain unauthorized access to other users' accounts, administrative functions or restricted sections of the Platform.

7.4. Take actions aimed at disrupting the normal operation of the Platform.

7.5. Use automated means to bulk-collect, copy or extract information from the Platform without Astana Bilim Academy LLP written permission.

7.6. Upload malicious programs, files or other objects to the Platform capable of disrupting the operation of the Platform or the devices of other users.

7.7. Attempt to circumvent technical restrictions, the authorization system or other security measures of the Platform.

7.8. Post materials containing threats, insults, discrimination, illegal content, or materials that infringe the rights of third parties.

7.9. Use the Platform to send spam, advertising or other messages unrelated to the educational process without Astana Bilim Academy LLP permission.

8. User Content

8.1. Where the Platform's functionality allows a user to post messages, replies, comments, files, assignments or other materials, the user is solely responsible for the content of the material posted.

8.2. The user guarantees that the materials posted: do not violate the legislation of the Republic of Kazakhstan; do not infringe the rights and legitimate interests of third parties; do not infringe copyright or other intellectual property rights; do not contain malicious software.

8.3. Astana Bilim Academy LLP may remove or restrict access to user material where there are grounds to believe that its posting violates this Agreement, the rights of third parties, or the legislation of the Republic of Kazakhstan.

9. Notifications and Communications

9.1. Astana Bilim Academy LLP may send the user notifications related to the operation of the Platform and training via e-mail, SMS, telephone, messengers, in-Platform notifications, and other contact details provided by the user.

9.2. The user must independently ensure the ability to receive such notifications.

9.3. Notifications directly related to training do not constitute advertising messages.

9.4. Advertising and marketing messages are sent in accordance with the legislation of the Republic of Kazakhstan and where the relevant grounds exist.

10. Personal Data

10.1. Use of the Platform may involve the collection and processing of the user's personal data.

10.2. Personal data is collected and processed in accordance with the legislation of the Republic of Kazakhstan and a separate Consent to the Collection and Processing of Personal Data provided by the user.

10.3. This Agreement does not replace the Consent to the Collection and Processing of Personal Data.

10.4. The detailed procedure for processing and protecting personal data is set out in Astana Bilim Academy LLP Privacy Policy.

10.5. The user may exercise their rights with respect to personal data in the manner provided for by the legislation of the Republic of Kazakhstan, the Privacy Policy, and the Consent to the Collection and Processing of Personal Data.

11. Technical Requirements and Platform Availability

11.1. To use the Platform, the user must independently ensure the availability of a computer, tablet or other compatible device; the necessary software; an internet connection; and an up-to-date browser or other software required for the Platform to operate.

11.2. Astana Bilim Academy LLP is not liable for the impossibility of using the Platform caused by technical circumstances on the user's side, including equipment malfunction, lack of internet connection, or inadequate connection quality.

11.3 Astana Bilim Academy LLP may temporarily restrict access to the Platform for technical maintenance, software updates, elimination of technical faults, ensuring information security, or other necessary technical work.

11.4 Astana Bilim Academy LLP takes reasonable measures to restore the operability of the Platform in the event of technical faults.

11.5. Certain functions of the Platform may be temporarily unavailable due to technical reasons, actions of telecom operators, hosting providers, software developers, or other circumstances beyond Astana Bilim Academy LLP direct control.

12. Restriction and Termination of Access

12.1. Astana Bilim Academy LLP has the right to temporarily restrict or terminate a user's access to the Platform in cases of: breach of this Agreement; transfer of account credentials to a third party; attempted unauthorized access; infringement of intellectual property rights; distribution of educational materials; actions creating a threat to the security of the Platform; violation of the legislation of the Republic of Kazakhstan.

12.2. Where a restriction of access relates to a paid course, the consequences of such restriction are also determined by the Public Offer Agreement.

12.3. Termination of access to the Platform does not release the user from obligations arising before the moment access was terminated.

13. Relationship with Other Astana Bilim Academy LLP Documents

13.1. This Agreement governs the use of the Platform as a digital resource.

13.2. The terms for the provision of paid educational services are governed by a separate Public Offer Agreement for the provision of paid educational services.

13.3. The procedure for processing and protecting personal data is governed by the Privacy Policy and the Consent to the Collection and Processing of Personal Data.

13.4. In the event of a conflict between this Agreement and the Public Offer Agreement regarding the terms of educational services, the provisions of the Public Offer Agreement shall prevail.

13.5. Matters directly related to the use of the Platform and not governed by the Public Offer Agreement are governed by this Agreement.

14. Acceptance of the Agreement

14.1. Before starting to use the Platform, the user must read this Agreement.

14.2. Upon registration on the Platform, acceptance of this Agreement may be confirmed by checking the box "I accept the User Agreement," clicking the relevant button, or performing another action provided by the Platform interface that unambiguously evidences acceptance of the Agreement.

14.3. If the user does not agree with this Agreement, they may not use the Platform in respect of the functions for which acceptance of the Agreement is mandatory.

14.4. The fact of acceptance of the Agreement may be recorded by Astana Bilim Academy LLP information system, indicating the date, time, user account, and version of the Agreement.

15. Amendment of the Agreement

15.1. Astana Bilim Academy LLP has the right to make amendments and additions to this Agreement.

15.2. A new version of the Agreement is published on the Platform and takes effect on the date specified in the new version, or upon its publication, unless another period is established.

15.3. For users who have already accepted a previous version of the Agreement, amendments apply from the moment of their acceptance in the manner provided by the Platform, unless otherwise prohibited by the legislation of the Republic of Kazakhstan.

15.4. Astana Bilim Academy LLP has the right to retain an archive of previous versions of the Agreement.

16. Liability

16.1. The user is liable for breach of this Agreement in accordance with the legislation of the Republic of Kazakhstan.

16.2. The user is liable for actions performed using their account, unless they prove that such actions were performed without their involvement and through no fault of their own.

16.3. Astana Bilim Academy LLP is not liable for damage arising from: the user's breach of the rules for using the Platform; the user's disclosure of authorization data to third parties; use of faulty equipment; absence or inadequate quality of internet connection; actions of third-party services and telecom operators; force majeure; or other circumstances beyond Astana Bilim Academy LLP direct control.

16.4. Limitations of liability apply to the extent permitted by the legislation of the Republic of Kazakhstan.

17. Final Provisions

17.1. This Agreement is governed by the legislation of the Republic of Kazakhstan.

17.2. All matters not governed by this Agreement are governed by the legislation of the Republic of Kazakhstan, the Public Offer Agreement, and other applicable Astana Bilim Academy LLP documents.

17.3. The invalidity of any individual provision of this Agreement does not entail the invalidity of its other provisions.

17.4. All disputes and disagreements related to the use of the Platform shall be resolved through negotiation, and, if a settlement cannot be reached, in the manner established by the legislation of the Republic of Kazakhstan.

17.5. This Agreement applies to the user from the moment of its acceptance until the user ceases to use the Platform or the Agreement is terminated.
